GENERAL REGULATIONS FOR THE PROVISION OF THE INFORMATION SERVICES

I. GENERAL RULES

These General regulations for the provision of the information services (hereinafter referred to as the “Terms of service”) regulate the principles of rendering of the information services by the provider. The provider of the information services relating to the sale of a pre-made and (or) a customized guides (hereinafter referred to as the “Services”) is the individual entrepreneur Inesa Tarazevich (hereinafter referred to as the “Provider”), Taxpayer Identification Number 6793245709, tel. no. +48 572197422, e-mail for correspondence: iness.britain@gmail.com, with registered office at Straganiarska 20/22, office 35, 80-837 Gdańsk. The customer of Services (hereinafter referred to as the “Customer”) is each person that purchases of the pre-made and (or) the customized guide created, prepared and (or) designed by the Provider. The rights and obligations of the Provider and the Customers are defined on the basis of Poland Civil Code and other applicable legislation of Poland.

The Terms of service constitute an integral part of contracts, offers, orders, order confirmations and other contractual documents, and in such scope they apply to the Provider and its Customers, unless both contracting parties decide otherwise.

The Terms of service shall apply to all contracts concluded between the Provider and the Customer and to all factual and legal actions undertaken by the Provider and the Customer in order to perform the concluded contracts.

II. CONCLUSION AND PERFORMANCE OF THE SERVICE CONTRACT

The Service contract is concluded by the Customer submitting an order to the Provider to perform the Service on the basis of the Provider’s offer or without such an offer, which integral part is the Terms of service, and then confirming the acceptance of the Client’s order by the Provider. The Customer’s order may be made by the submission of the special form available on the Provider’s website (https://www.exploringbritain.co.uk/) and in respect of the customized guide by email as well. In respect of the pre-made guide conclusion of the Service contract occurs when the Service contract is confirmed by the Customer by using the special form available on the website (https://www.exploringbritain.co.uk/) and the prepayment of the price referred to in clause III of these Terms of service is made. When making the order the Customer is required to provide the following contact information: name, surname, telephone number, e-mail address, country of residence, card details and other information if applicable.

The Customer’s order shall be deemed accepted if the Provider confirms the acceptance of the order by e-mail and in respect of the pre-made guide if the Customer makes the prepayment of the price of Services. The pre-made giude is sent to the Customer within 6 hours after prepayment is made. The conclusion of the Service contract shall mean acceptance of the Terms of service by the Customer.

The Provider performs the Services in the part of preparation of the customized guide within the time agreed between the parties. The Provider guarantees the performance of the Services in the part of preparation of the customized guide within the agreed time on condition that the Customer performs all the necessary actions (providing required information, budget, preferences, etc.) for the proper order performance by the Provider and makes payments of the price of Services in the agreed term(s). The conclusion of the Service contract in respect of the customized guide shall mean the Customer’s confirmation by email of all agreed conditions of preparation of the customized guide with the Provider and acceptance of the Terms of service by the Customer.

III. TERMS OF PAYMENT

On conclusion of the Service contract the Customer is obliged to pay to the Provider payment on date and at the price indicated in the Provider’s confirmation of the order or specified in earlier sent conditions of payments or accessible on the Provider’s website (https://www.exploringbritain.co.uk/). The price of the Services is expressed in GPB and includes all the Services provided by the Provider listed in the order, confirmation of the order and (or) on the Provider’s website (https://www.exploringbritain.co.uk/). The prices for the Customer are contractual and may include VAT if applicable. In respect of the pre-made guide the Customer in online form chooses the payment option and pressing the “submit/pay/confirm payment” button on the website.

The order of the Services cannot be submitted and (or) confirmed without checking the box: I have read and accepted the Terms of service. In respect of the customized guide after the order is submitted the Customer via email receives the confirmation and suggestion for negotiation of the particular provisions of the order. Such confirmation may include instructions regarding payment method, terms of Services, ways of negotiation of the details of the order and other details of the Services to be agreed. After completion of the negotiation of the all details of the order the Customer will be informed via email that the order of the Services is confirmed. Negotiation of the particular provisions of the order may be conducted via telephone, video calls, by exchanging of the emails and by other means.

The date of payment is the day when the money are accepted by the Provider’s bank and sent to the Provider’s account. Failure to pay the price of the Services on the dates indicated above denotes Customer’s order.

IV. DISCLAIMER / LIMITATION OF LIABILITY

The Provider limits its liability for non-performance or improper performance of the Service contract towards the Customer to the cost of the provided Services.

The liability of the Provider is excluded if it involves:

  • actions or omission of the Customer,
  • actions or omissions of the third parties, not participating in the performance of Services provided in the Service contract, if such acts or omissions could not have been foreseen or avoided,
  • force-majeure circumstances.

The Customer is obliged to comply with the passport, customs, health and other regulations of the United Kingdom or other countries if applicable. Any costs incurred as a result of breach of these regulations are charged to the Customer.

V. RESPONSIBILITIES OF THE CUSTOMER

The Customer is required to hold valid travel documents: a valid passport (for countries outside the European Union), passport or identity card (for countries belonging to the European Union) or a tourist visa when it is necessary. Furthermore, the Customer must comply with custom rules and foreign exchange regulations which are in force in the Republic of Poland and also other countries of transit and destination. This obligation to hold a valid travel document also applies to children, regardless of their age.

The Customer is obliged to comply with the provisions of law and order, and safety (e.g. fire rules, police announcements, airports rules, etc.).

The Customer shall be liable for damages done to the belongings of hotels, restaurants, airlines etc. The Customer is responsible for any damage or loss caused by his fault or the fault of juveniles who are under supervision or care of the Customer. After finding the Customer’s fault, the date of payment or way of fixing the damage is established.

VI. COMPLAINTS

If the Customer finds the performance of the Service contract in any respect defective, he or she shall immediately notify the Provider, who as far as it is possible, is required to correct the defect. The “prompt notice” obligation means the complaint notification at the earliest opportunity (as in art. 5 paragraph 4 of the Council Directive of 13 June 1990 (90/314/EEC)). The notification shall be made by the Provider in documentary form in writing, by e-mail or by using of the form available on the Provider’s website (https://www.exploringbritain.co.uk/).

The complaint notification should be legible. If the complaint notification is illegible, the Provider will invite the Customer to re-submit the complaint notification in readable form. In this case, the complaint notification time limits shall be suspended.

VII. FINAL PROVISIONS

All the relations and (or) agreements concluded between the Provider and the Customer are governed by Polish law. Any disputes the parties shall settle amicably and in the absence of agreement by the competent local court. The invalidity of individual provisions of the Service contract or of these Terms of service shall not affect the validity of the entire Service contract.
